Debt Settlement Agreement
R449
Create a debt settlement agreement recording a negotiated settlement of an outstanding debt, including the settlement amount, payment terms, waiver conditions, default consequences, and full-and-final settlement wording.
A Debt Settlement Agreement is used where a creditor and debtor agree to resolve an outstanding debt through payment of an agreed settlement amount or settlement terms.
South African legal context (2026 checklist)
The agreement should state whether the settlement replaces the original debt, suspends enforcement, or only becomes effective once payment is made in full. If a reduced amount is accepted, the agreement should say whether the balance is waived only after full compliance.
